By registering to participate in the Oconomowoc Summer Farmers’ Market, you acknowledge understanding and acceptance of the Market guidelines and policies described in these documents. The Oconomowoc Area Chamber of Commerce Events Coordinator reserves the right to limit items/products sold at the market to ensure product diversity. The Oconomowoc Area Chamber of Commerce reserves the right to modify the policies at any time.

I have read and understand the policies and guidelines as outlined for the Oconomowoc Summer Farmer’s Market and hereby agree to abide by them. I acknowledge full responsibility for all my activities (and those assisting me) in the Summer Farmers’ Market throughout the term of this agreement. *

DOCUMENTATION, LICENSES AND PERMITS: Vendors are responsible for full compliance with all applicable federal, state and local laws. It is the vendor’s responsibility to obtain all licenses and permits, and to pay the fees required by local and state governments. All pre-packaged items must be labeled in accordance with these regulations. The vendor is responsible for monitoring and maintaining proper temperatures in accordance with health codes. Vendors who sell foods that must be kept refrigerated or frozen must have an accurate thermometer at the market. *

LIABILITY INSURANCE: Before I can participate in the market, I am required to have my own general commercial liability, products liability, and property and casualty insurance policy and additionally name the Greater Oconomowoc Area Chamber of Commerce, Inc. as additional insured. Vendor shall provide a certificate of insurance to the Chamber, which complies with the preceding sentence, and which also states that the Chamber shall be provided at least 30 days prior written notice of any cancellation of the policy to which the certificate relates. Such certificate must also state that the Vendor’s insurance company waives subrogation against the Chamber. The general commercial liability policy must have Each Occurrence limits of at least $1M. I, as owner, as well as my business, covenant and agree that I/we shall indemnify, defend, and hold harmless, the Greater Oconomowoc Area Chamber of Commerce, Inc., its officers, directors, affiliates, employees, contractors, successors, heirs, and assigns (collectively, the “Chamber Indemnified Parties”) from any and all liability, claims, demand, causes of action, associated with (i) my and/or my business’ participation in the Farmers’ Market, (ii) any product or service marketed and/or sold, transferred, conveyed, available for sampling, any liabilities, claims, demands, causes of action or the like (iii)the operation of the Vendor’s business in any way or participation by Vendor in the Farmers’ Market, including but not limited to, any claims of productliability, any claims of misrepresentation or fraud, claims for any damages, structural, or otherwise, to or within the venue, (iv) any misrepresentations of statements made in this Agreement by me and/or my business and/or breaches of this Agreement by me or my business, and also including all costs associated with the same incurred by the Chamber Indemnified Parties related to any of the foregoing, including attorneys, accountants, and other professional fees, and/or costs or expenses associated with the same. The Chamber reserves the right to charge vendors for any damage incurred and Vendors shall be responsible for the costs of collection related to the same incurred by the Chamber Indemnified Parties (including attorneys’ fees). Failure to report damages will result in immediate dismissal from the market with no refund of fees.” *

WEATHER: I understand that there are no refunds or rescheduling of dates due to inclement weather or non-attendance at scheduled markets. *

BOOTH LOCATION/ATTENDANCE: Spaces may vary slightly due to demands of the venue layout. I also understand that two (2) no call/no shows may permanently remove me from the market. There are NO REFUNDS given once accepted into the market. *

INTERACTIONS WITH OTHERS: My interactions and behavior with others (vendors, consumers, Market Monitor and OACC Events Coordinator) will be professional and courteous. Any concerns, conflicts or disagreements will be brought to the Market Monitor and or the OACC Events Coordinator. *

I have read and understand the Oconomowoc Area Chamber of Commerce Market information, policies and guidelines. I agree to abide by all the rules and regulations of the Oconomowoc Farmer’s Market(s). The Oconomowoc Area Chamber of Commerce reserves the right to modify the policies at any time. By registering to participate in the OSFM and signing below, you acknowledge understanding and acceptance of the market rules and guidelines described in these documents and I am authorized to sign the agreements on behalf of the business identified below *
